Terms and conditions - short-term online course

This online course is conducted by our education partner, RMIT Online Pty Ltd, a company registered in Australia (ABN 38 614 454 170) (RMIT Online). By registering to this Course, you are acknowledging that you will be enrolled as a student of RMIT Online and that you will be subject to the rules, policies, procedures and processes that apply to RMIT Online students. 

Your enrolment in an online course is subject to you complying with applicable eligibility and prerequisites set by RMIT Online. 

Studying with RMIT Online

When you study with RMIT Online, you agree to comply with RMIT's Policies and Terms, including the policies relating to Privacy (and how your personal information is collected and managed) and the Statement of Student Responsibilities.  

If what you are studying (the Course) involves an external partner product, such as a chat or meeting tool or a tool for facilitation of a pin or credential, you may be required to accept their user terms in order to participate in or to complete the Course, and to provide them with your personal information. Other key features and terms may also be set out in the relevant course guide or FAQs.

For some Courses, and subject to satisfactory performance as determined in RMIT Online's sole discretion, you may be eligible to purchase (or be awarded, if applicable) products that record your participation in the applicable Course, including (but not limited to) a statement, certificate, acknowledgment or similar issued by RMIT Online (a "Credential"). You acknowledge and understand that a Credential, if offered, does not replace any course taken at an accredited institution and in no way transmits or replaces academic credit in the accredited course offered by RMIT Online or other accredited institutions. You acknowledge that neither RMIT Online, nor the instructors of the Courses, or any other institution or organization will participate in any attempt to obtain recognition of the Courses as accredited courses in an accredited institution. 

Payment and discounts

For most online courses, participants will be required to make the payment at the time of enrolment or reservation. 

For organisations that are booking a Course for numerous team members, staff or nominated participants, an invoice will generally be issued upon receipt of a purchase order or letter from the relevant authority. This invoice must be paid in full as required on the invoice. In general, a full course fee remains payable even if a participant does not attend, log in or complete the relevant course.

Some Courses can be paid for in conjunction with a promotional code or other discount agreement. Promotional codes can only be used once per person during the relevant promotional period to provide a discount on the course fee. Unless otherwise specified in the promotional terms, the total amount of all applicable discounts may not exceed 25% of the Course fee. In general, you must notify us prior to payment if you are eligible for any discount.

Changes and Cancellations on behalf of RMIT Online or BAU

BAU or RMIT Online may need to change the details of a Course or cancel a Course due to circumstances beyond our reasonable control, including insufficient enrolments. If a Course is cancelled, we will offer you a refund or an alternative enrolment in a different Course, or a subsequent Course offer.

Cancellation on behalf of students

For online courses:

  •  we require you to cancel in written form; and

  • you can cancel your enrolment free of charge, with a full refund, up to 5 working days before the course start date. 

If you have purchased a programme (i.e. a series of online courses in a package), the refund may be limited to the remaining courses that have not yet started, and will be net of discounts received for short courses that have been taken.

You may request a special consideration if you need to cancel an enrolment after the stated deadline and want a refund. Depending on how much time has elapsed since the course start date or deadline, we may only be able to provide a partial refund, or we may not be able to provide a refund at all.

Refunds will only be credited to the original method of payment (e.g. credit card) or through other means approved by BAU.

Transfers and postponements

For online courses, you may transfer to another course with the same value at no cost, provided that you make a written request within 5 working days from the start of the course.  A 10% administration fee of the course fee will be applied if a request is made after this time but before the course starts.  We will not accept any changes to enrolments, including transfers, after the Course starts.

Whether you can postpone an online course depends on whether it is scheduled to be held at a later date and on the applicable enrolment process. We cannot guarantee that a Course will always be held at a future date. If we are unable to postpone your enrolment, it will be treated as a cancellation.

  • If you are able to defer to a later session of the same Course, any assignments that you have completed prior to deferring will not be credited to the Course when you re-enrol.

  • You can only defer from the current Short Course to the next available Short Course of the same type.

If you are transferring from another Course, the Course start date will be considered to be that of the original Course in which you first enrolled.

Privacy

It is necessary to attach a copy of your identity card or passport. If you do not have one of these documents, your registration will not be valid. 

In accordance with EU Regulation 679/2016 and Organic Law 3/2018 on confidentiality and data protection, your personal data, known to BAU, Centro Universitario de Diseño, will be entered in the records and academic management files of the University Secretary's Office for the purpose of recording and monitoring the studies and services offered to its students, teaching organisation, for carrying out other functions related to the higher education service and for information purposes.

By registering on this Course, you expressly agree that BAU may transfer your personal information and other data to RMIT Online for the purposes of managing your registration and delivering the Course.  You acknowledge and accept that your personal information will be managed in accordance with RMIT's Privacy Statement and RMIT's Student Privacy Statement. You also agree that RMIT Online provides BAU with information about your participation in the Course, including whether you have successfully completed or not completed a Course.  BAU and RMIT Online have signed EU-approved standard contractual clauses to provide adequate guarantees and appropriate for international transfer outside the EU and EEA.

We also inform you that the personal details you provide us with may be communicated at any time to the company responsible for BAU Comunication. We also inform you that, as a result of BAU, Centro Universitario de Diseño's activity, both the images taken as students of the centre and the work carried out as students (with the corresponding acknowledgement of the authorship) may appear in photographs, videos or any other audiovisual support corresponding to the teaching, complementary and extracurricular activities organised by the centre and published on the website or in other printed or audiovisual media. Furthermore, we inform you that your data may be kept in the file once you have left the Centre or have completed your studies, disassociating the expiry of your legal responsibilities.  The data owner is obliged to notify BAU, Centro Universitario de Diseño in written form of any change that may occur in the data provided while the owner is associated with the Centre.

Finally, we inform you that you will be able, at any time, to exercise your right to access your personal information, rectify inaccurate data, delete data that are no longer needed and for any of the other purposes provided for by the RGPD, oppose their processing for reasons related to your particular circumstances, as well as limitation and portability, and the right not to be subject to a decision based solely on automated processing, including profiling, in accordance with the terms set out in Organic Law 3/2018 by contacting BAU, Centro Universitario de Diseño at Pujades 118, 08005 Barcelona, indicating the reason for the request together with a copy of your ID card or a passport.

In the event that the data provided belongs to a third party, you guarantee that you have informed this third party of the aspects contained in this document and obtained their authorisation and consent to provide their data to BAU, Centro Universitario de Diseño, S.L. and RMIT Online for the aforementioned purposes.

General

To the extent permitted by law, BAU and RMIT Online are not responsible for any indirect, special, incidental, consequential or other damages (including, without limitation, loss of revenue or income, loss of business, loss of profits or contracts, loss of opportunities, loss of anticipated savings, loss of data, loss of goodwill), regardless of the manner in which they arise and regardless of whether they are caused by tort, breach of contract or otherwise, even if the parties have been advised of the possibility of such damages.  

In these terms, Business Days is considered to be any day in metropolitan Victoria, Australia, which is not a public holiday, Saturday or Sunday.
